Family Law Legislative Update 2015 - 02-03

Here is the latest.  Still no word on the proposed legislation to codify child custody decision making.

Four things have been added since the last update:

HB 220 is the Maryland Collaborative Reproduction Act, a familiar bill introduced in 2013 and 2014.

HB 224, 225, and 227 are all domestic violence bills.

HB 224 provides for a 2 year protective order.  The text of the bill has not yet been posted.  The short synopsis says "a period not to exceed 2 years by consent of the respondent under specified circumstances."  Unless the synopsis is simply wrong, it's hard to imagine why the bill does any good; it's nice to provide for a 2 year protective order but it seems to defeat the purpose if the respondent has to consent.  Maybe it has to do with a situation in which there is going to be a consent and the judge is allowed to take a 2 year consent rather than a shorter one.

HB 225 provides for "additional relief."  Again, the text is not yet posted and the synopsis says "expanding the relief that may be awarded" in interim, temporary, and final protective orders.  More to come when they post the text.

HB 227 alters the definition of abuse in DV cases "to include harassment, trespass, and malicious destruction of property under specified provisions of law if the person eligible for relief has not resided with the respondent for at least 7 days before the filing of the petition."  The text has not yet been posted.

Open Enrollment & Medicaid Redetermination Fact Sheets

Hi all,

I was happy to be able to join the Public Benefits Task Force meeting today, and mentioned that the Drug Policy Clinic had developed two one-page fact sheets with basic dates and other information related to Medicaid redeterminations and the upcoming Open Enrollment period for Qualified Health Plans.  The attached PDFs are in color for online posting, but they print out just fine/legibly on a black and white printer.

The Clinic is looking forward to working with individuals on Medicaid and QHP issues.  As I mentioned at the Task Force today, no question is too minor (our students are happy to help field preliminary eligibility/application questions as well as post-eligibility determinations), and we have no income restrictions, so referrals from people over-income for legal Aid services are welcome.

New CSA Decision Re: Guardianship of a Child When Parent is Still Living

In Re Guardianship of Zealand W. and Sophia W.

Number 1280

September Term 2013

Filed October 29, 2014

Pursuant to a divorce in 2005 in South Carolina, Father was granted custody of Sophia and Zealand and Mother was granted supervised visitation. 

Father died in December of 2012.  Father's Cousin filed a petition for guardianship in the Circuit Court for Montgomery County.  The court granted temporary guardianship and entered a number of other orders, one finding Mother in contempt for failing to pay for a court-appopinted psychological evaluation.  Mother filed an interlocutaory appeal of several of the orders.

The Court of Special Appeals found that "the circuit court was not authorized, under section 13-702 of the Estates & Trusts Article to appoint a third party as temporary or permanent guardian of the person of either Zealand or Sophia when (1) the children's mother is alive; (2) mother's parental rights have never been terminated; and (3) no testamentary appointment has been made."

The CSA cited In Re Adoption/Guardianship of Tracey K., 405 Md. 82 (2008), saying that "Section 3-702(a) of the Estates & Trusts Article does not allow a circuit court to appoint a guardianship of the person of a minor child where (1) the mother of the child is still living; (2) the mother's rights have never been terminated in this state pursuant to Title 5 of the Family Law Article; and parental rights have not been terminated by any other court.

Affidavit Judgment Defense in District Court

This pro bono training will cover affidavit judgments in Baltimore City, how to know when a client could or should file bankruptcy, and an overview of contract litigation issues including: auto repossession, bail bonds, credit cards, homeowners' associations, landlord/tenant, medical debt, and student loans. 

Participating attorneys must submit a $25 non-refundable fee and attend 4 brief advice clinics hosted by the Consumer Protection Project at the Baltimore City District Court within one year of the training. 

Volunteer attorneys will have access to mentors, malpractice insurance, an email listserv, and more.

REPRESENTING UNACCOMPANIED YOUTH: SPECIAL IMMIGRANT JUVENILE STATUS (SIJS)

The Pro Bono Resource Center of Maryland (PBRC) is searching for volunteer attorneys who are willing to help the rising number of unaccompanied Central American youth who are fleeing violence and unrest in their home countries.  Over 2,800 minors have been placed in Maryland, giving our state the highest number of unaccompanied children per capita.  Any lawyer, whether Maryland-barred or not, is eligible to volunteer in this effort by providing pro bono representation to these vulnerable children and/or mentorship to other pro bono attorneys. 

Interested volunteers are invited to attend the below free training which will be suitable for attorneys of all experience levels. A live webinar is also available. Landlord/Tenant Training

This is a nuts and bolts training for landlord/tenant cases.  The training will cover:

- Security deposits

- Habitability issues, including how to initiate affirmative rent escrow cases or raise habitability as a defense in failure to pay rent cases

- How to practice in rent court

- Eviction proceedings, including defenses to breach of lease or tenant holding over claims and illegal fees and lockouts

There is no fee to attend, but each participant will be asked to accept one landlord/tenant case from Maryland Volunteer Lawyers Service over the next year.  The requirement is waived for attorneys in legal services agencies.

This training is intended to provide a comprehensive overview of the substantive law and procedural tools neededt o defend tenants in a variety of matters.

New Criminal Records Expungement resource!

I hope I am not spoiling anyone's pending announcement too badly ...

There's a new web-based resource for clienbts for clearing their criminal record. Find it at

The website has 3 buttons that explain what expungement is (What Is Expungement?), explain how to clear a user's criminal record (How Can I Expunge My Record?), and helps a user figure out whether their criminal record can be expunged (Can I Expunge My Record?).

Maryland Legal Aid Midwestern MD Office at Frederick Pride 2014
